Welcome to OptimaxTalent, operated by Byron Low (“Coach”, “we”, “our”, or “us”). These Terms and Conditions ("Terms") govern your use of our website, services, and participation in our 1-on-1 coaching program (“Program”). By accessing or using our website or services, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the website or enroll in the Program.

1. Program Overview

OptimaxTalent offers professional coaching services designed to support individuals in enhancing their leadership, communication, and execution skills. The Program is delivered primarily through 1-on-1 coaching sessions, which may include assessments, goal-setting, and action planning.

2. Eligibility

You must be at least 18 years old to participate in the Program. By enrolling, you confirm that all information provided is accurate and complete, and that you are legally able to enter into this agreement.

3. Booking and Payment

  • Coaching sessions are booked in advance by mutual agreement.

  • Payment must be made in full prior to the start of the Program unless otherwise agreed upon in writing.

  • Accepted payment methods may include credit/debit card, bank transfer, or online payment portals.

  • All prices are listed in USD unless otherwise specified.

4. Cancellations and Rescheduling

  • You may reschedule a session with at least 24 hours’ notice.

  • Cancellations made with less than 24 hours’ notice may be forfeited without refund.

  • If the Coach needs to reschedule, every effort will be made to offer a timely alternative.

5. Refund Policy

Due to the nature of coaching services, all sales are final. No refunds will be issued once the Program has started, except in cases of extenuating circumstances, at the Coach’s discretion.

6. Confidentiality

All personal information shared during coaching sessions is kept strictly confidential. However, there are exceptions where disclosure is required by law (e.g., imminent harm to self or others).

7. Code of Conduct

Clients are expected to:

  • Be respectful and professional during all interactions.

  • Be committed to their own growth and open to feedback.

  • Attend sessions on time and avoid distractions during coaching.

The Coach reserves the right to terminate the Program without refund in cases of inappropriate behavior or breach of these terms.

8. Intellectual Property

All materials provided by OptimaxTalent, including worksheets, frameworks, and assessments, are the intellectual property of Byron Low. These may not be copied, distributed, or used for commercial purposes without express written consent.

9. Disclaimers

  • Coaching is not therapy or counseling. It is a professional relationship intended to facilitate personal and professional growth.

  • Results are not guaranteed. Your progress depends on your own commitment and actions.

  • The Coach is not liable for any decisions made or actions taken as a result of coaching sessions.

10. Limitation of Liability

To the maximum extent permitted by law, Byron Low and OptimaxTalent shall not be held liable for any indirect, incidental, or consequential damages arising from your participation in the Program.

11. Changes to Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting on our website. It is your responsibility to review these Terms periodically.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of [Insert State], without regard to its conflict of law principles.
